A mechanic’s lien claim can and should be discharged (i.e. removed) from the property by the claimant once the underlying claim has been paid by the owner.
If the claimant fails to discharge the lien claim in a timely manner, the laws in which in the state where the improved property is located likely provide the owner of the property with the opportunity to pursue legal action for legal fees required to discharge the mechanics’ lien claim. The property owner is also accorded the opportunity to challenge a mechanic’s lien claim when received, but the procedure and process required to successfully challenge an unwarranted, inflated or otherwise improper lien claim varies by state.
