Filing a mechanic’s lien claim allows an unpaid contractor or material supplier to attach his or her debt directly to the title of the improved property without having to address other requirements which are otherwise required by the claimant’s agreement for the project.
These contractual defenses could be cited to challenge the viability of the mechanic’s lien claim, but no term contained in the contract between the parties will can prompt a party to the contract to forfeit its statutory right to otherwise file a mechanic’s lien claim.
